without notice to you. Changes will apply to any subsequent orders

1. Your Account
a. General Disclaimer
All
products sold on the Ad Hominem website are intended to be sold to
adults over the age of 18, who can purchase with a credit card or
cheque. Ad Hominem reserves the right to refuse service, terminate
accounts, remove or edit content, or cancel orders at its sole
discretion.
b. Your Personal Information
If you
use this site, you are responsible for maintaining the confidentiality
of your account and password and for restricting access to your
computer, and you agree to accept responsibility for all activities
that occur under your account or password. We will take all reasonable
precautions to keep the details of your order and personal information
secure, but, unless we are negligent, we cannot be held liable for any
losses caused as a result of unauthorised access to information
provided by you. Credit card payments on this site are made using
external merchant services, and your credit card details are not passed
to us at any time. If you do provide us with personally identifiable
information, we may use it to improve our understanding of your
interests and concerns. We will also use this information to process
your order.
c. Electronic Communications
When you visit the Ad Hominem
website, or send e-mails to us, you are communicating with us
electronically, and you consent to receive communications from us
electronically. We will communicate with you by electronic mail or by
posting notices on this site. You agree that all agreements, notices,
disclosures and other communications that we provide to you
electronically satisfy any legal requirement that such communications
be in writing.
d. Third Party Links
From time to time, this website may
contain links to websites that are not owned, operated or controlled by
Ad Hominem. All such links are provided solely as a convenience to you
the client. If you use these links you will leave this website. Ad
Hominem is not responsible for any content, materials or other
information located on or accessible from any other website.
2. Your Order
a. Ordering online
You are only permitted to order via Ad Hominem
website if we have had a prior appointment with you to obtain all your
detailed personal measurements, this is to ensure that any orders
processed fit you and you alone.
b. Order Confirmation
We
will notify you by email as soon as possible to confirm receipt of your
order. We will notify you again upon arrival of your order to the Ad Hominem offices.
c. Order Fulfilment
The
construction of your item will begin 24 hours after authorisation of a
down payment (this is a deposit for half the total amount) for the item
has been obtained. Since all of our items are made to your exact
specifications and are made carefully by hand, it will take
approximately 3 working weeks for your order to be processed. We make
every effort to deliver goods within these timescales, but delays are
occasionally inevitable. We shall be under no liability for any delay
or failure to deliver the products within the estimated timescales.
c. Delivery Charges
Most
orders will be hand delivered unless otherwise pre-arranged between the
client and Ad Hominem. For any pre-arranged postal deliveries,
delivery will be made by insured signed-for parcel post, and as such
the liability for damage during transit will rest with the carrier.
d. Fabric Colour Reproduction
Ad
Hominem takes great care with the fabric colour and patterns
displayed. The limitations of colour reproduction and the individual
colour settings of your screen may mean a very slight variation between
the fabric shown on the screen and the fabric received. Every
reasonable care has been taken to ensure that the descriptions and
depictions are accurate.
e. Fabric Colour Consistency
While
Ad Hominem makes great efforts to ensure our fabric colours remain
consistent, due to the variable nature of yarn production, texture and
hues of fabrics may vary over time. Thus, Ad Hominem cannot guarantee
that two items made in the same fabric colour, but ordered at
intervals, will match perfectly in colour and texture.
f. Fabric Colour Availability
On
rare occasions, the fabric colour requested for your item may not be
available due to circumstances beyond our control. In these cases, we
will contact you to offer you an alternate fabric colour. If this is
unsatisfactory, any payment made for the item will be refunded in full.
g. Quality Problems and Returns
If you are not
satisfied with the fit or quality of your item(s) please contact us
within 28 days of receipt and we will, at our discretion:
1. Make the adjustments necessary to address your issues
2. Offer to remake the garment
h. Cancellations and Changes.
Cancellations
or changes in the order are possible up to 24 hours after the order is
placed. After this the order is processed and the tailoring of an item
begins, therefore cancellation is not possible. To cancel or change an
order, you should e-mail us, quoting your order and name. If a change
in an order implies an increase in the amount of the order, we will
advise you of this, and will require additional payment before the
order can be completed. If a change in an order implies a decrease in
the amount of the order (e.g. cancellation of a particular item), we
will reimburse you for the appropriate amount.
i. Any Problems
If
you are dissatisfied in any way with your order please contact us and
we will deal with your complaint at the earliest possible convenience.
3. General Points
a. Pricing
All
prices shown are sterling prices including 17.5% VAT payable by
European Union residents. All prices are correct at the time of
publishing online, but Ad Hominem reserves the right to change its
prices. If you have ordered and paid for an item, and the price of that
item subsequently changes before delivery, such a change will not
affect you. We try to ensure that the prices quoted are correct and
that all products are accurately described on this website. However,
orders will only be accepted if there are no material errors in the
description or price of goods displayed on this website. If we discover
an error in the price or description of goods that you have ordered, we
will inform you as soon as possible and give you the option of
reconfirming your order based on the correct price or description, or
cancelling it. If we are unable to contact you, we will treat your
order as cancelled.
b. Product Liability
We've
selected our products on the basis that they will be used for personal
use only and we will not be liable for any loss resulting from the
commercial use of our products.
c. Legal Jurisdiction
All
our consumer contracts are governed by English law and shall fall under
the Exclusive Jurisdiction of the Courts of England and Wales. English
is the only language offered for the conclusion of the contract.
If
any of these conditions shall be deemed invalid, void, or for any
reason unenforceable, such condition shall not affect the validity and
enforceability of any of the remaining conditions contained herein.
